AGC Testifies in Support of HB26-1014 Extend Colorado Job Growth Tax Credit
AGC Advocacy Director Michael Gifford testified in Support of HB26-1014 Extend Colorado Job Growth Tax Credit. This is the main job growth tax credit the Office of Economic Development & International Trade (OEDIT) uses to recruit new high paying businesses to Colorado. One example is Charles Schwab in 2013, where OEDIT granted $3.8M in tax credits for the creation of 418 jobs. Charles Schwab subsequently built a 4,500 employee campus in Lone Tree. The bill was approved on a 9-2 bi-partisan vote and now goes to the next step in the legislative process.
AGC & Colorado Chamber Lead Opposition to State OSHA Bill (duplicate of Fed OSHA)
AGC members sent 1,261 emails to House Business & Labor Committee Opposing HB26-1054
AGC continues the fight against a bill to establish a state version of OSHA with new enforcement rules and fines - HB26-1054 Protections for Worker Safety while keeping Fed OSHA in place in CO. AGC is OPPOSED to this bill and has partnered with the Colorado Chamber and a growing group of business organizations to stop it on an opposition Fact Sheet.
AGC members have sent in 1,261 emails to the House Business & Labor Committee asking them to oppose the bill. The bill us up in the House Business & Labor Committee on Thursday, Feb 26 at 1:30pm at the State Capitol in HCR 0112.
Tariff Update
The Supreme Court struck down IEEPA-based tariffs, but a new 10% global tariff is in effect under Section 122 of the Trade Act
On February 20, the U.S. Supreme Court issued a decision holding that the International Emergency Economic Powers Act (IEEPA) does NOT authorize the President to impose tariffs. However, the Court did not order refunds or set a refund process for tariffs already paid. Any tariff refunds (if they occur) would generally run through normal Customs processes and typically go back to the importer of record who paid the tariff invoice (usually not the contractor).
AGC of America is still actively analyzing the effects of the ruling, but below are the top-level takeaways for members. This decision is specific to IEEPA-based tariffs, meaning the following tariffs have been struck down:
- Reciprocal
- Minimum universal/global tariffs
- China
- Canada
- Mexico
- Brazil
- India
The Administration has already pivoted to a “Plan B,” issuing a temporary global tariff of 10% under Section 122 of the Trade Act of 1974 for up 150 days. Imposing tariffs under Section 122 is incredibly rare and legally untested, meaning that court challenges for this tariff are to be expected in the future.
In addition, previously imposed tariffs on construction materials such as steel, aluminum, copper, and softwood lumber are still in effect as they were put in place using other trade laws that have stood up to court challenges.
